Through Law 14/2013, on support for entrepreneurs and their internationalisation, non-resident foreign nationals wishing to enter Spain to carry out a ‘significant investment’ of capital can apply for a residence visa for investors. The office of AR Abogados Asociados offers legal advice to companies and entrepreneurs, within the framework of the aforementioned Law, on the management and obtainment of said residence visa and permit, as well as access to a portfolio of collaborating companies specialised in the real estate and business sector.

Thanks to this Law, a visa and permit is now available to entrepreneurs and foreign investors, among others, as long as the investment meets certain conditions.
1. RESIDENCE VISA FOR INVESTORS
1.1. Capital investment
a. Initial investment of no less than 2 million euros in Spanish government debt securities.
b. Initial investment of no less than 1 million euros in stocks and shares of Spanish companies or bank deposits in Spanish financial entities.
1.2. Real estate investment
Purchase of real estate in Spain with an investment equal to or greater than 500,000 euros from each applicant, free of liens or encumbrances.
1.3. Business project developed in Spain and proven to be of ‘general interest’, for which purpose it will be assessed to ensure it meets one of the following conditions:
a. Job creation.
b. Investment with a significant socioeconomic impact on the geographic area.
c. Relevant contribution to scientific and/or technological innovation.
Validity: The residence visa will allow investors to reside in Spain for at least one year
2. RESIDENCE PERMITS FOR INVESTORS
Investors who wish to reside in Spain beyond the period for which their visa is valid may apply for a residence permit for investors. In order for the permit to be granted a series of legal requirements must be met.
Validity: The initial residence permit for investors will be valid for 2 years, renewable upon application by the investor.
3. REQUIREMENTS
The investor should accredit, in addition to the general entry and residence requirement for foreign nationals who are not going to engage in remunerated activities, the following:
a. That they have not entered or stayed in Spanish territory as an undocumented immigrant.
b. That they are of legal age (over 18).
c. That they have no criminal record for crimes existing under Spanish law in Spain or in any of the countries where the applicant has previously resided.
d. That they have not been refused entry into any of the Schengen countries.
e. That they have a public or private health insurance from an entity authorized to operate in Spain.
f. That they have sufficient economic means to cover personal living expenses as well as those of any family member seeking residence.
